Insurance repairs can be a tricky matter.
Here at Kelly Roofing, we understand many of our customers file claims with their insurance companies in order to cover the costs of roof repairs or replacement. We’ve helped customers through many major hurricanes since 1972 throughout Florida.
However, it’s extremely important to understand what your insurance covers and that you have some say in the roof repair and replacement process when it comes to filing a claim. It’s why we urge homeowners to steer clear of roofing companies who ask you to sign an Assignment of Benefits Agreement.
What is an Assignment of Benefits Agreement?
An assignment of benefits agreement gives the rights of your insurance claim or the benefits of your insurance to a third party. Basically, a third party outside of your insurer will have the ability to file a claim, make decisions regarding the repair or replacement of your roof, and collect insurance payments — all without you being involved.
Why Should You Avoid Signing an Assignment of Benefits Agreement?
Because filing an insurance claim can be a bit of a headache due to the bureaucracy of everything involved, an assignment of benefits agreement may seem like a good idea. Why wouldn’t you want your roofing company to just handle the insurance claim as well as whatever repairs are required? The reason why is because you’re giving up all control related to the process. This means:
- The roofer will have the rights and benefits of your insurance.
- The insurer will only communicate with the roofer regarding the claim.
- You won’t have any say or be able to make any decisions regarding the claim.
- The roofer will be able to file suit against your insurer without your knowledge.
- The roofer could endorse checks on your behalf.
The assignment of benefits agreement is legally binding and can’t be canceled. It also isn’t needed for repairs to begin. The State of Florida has many helpful resources to download and read before you sign any sort of contract with a roofer.
Know Your Rights
When you have damage, here are some tips to keep in mind. Be the first person to call your insurance company about any damage. By filing the claim, you will remain in control and have a say in what repairs happen and the materials used. Carefully read every form before signing, and don’t sign anything before all of your questions are answered. An is not required for repairs to begin – don’t allow anyone to pressure you into signing one.
Signing an assignment of benefits agreement gives the roofer power to determine what needs to be repaired or replaced and to file a claim based on how much they are going to charge. Keeping this in mind, it’s the last thing you’ll want to sign. Here at Kelly Roofing, we discourage such contracts because we know it is important for you to remain in control of your home.
